SOS provides custom website design and development, brand identity direction, and optional ongoing hosting and site maintenance for independent musicians, artists, managers and agencies. Services are delivered remotely.

The exact deliverables, page count, timeline and price for each engagement are confirmed in writing by email before work begins. That written scope, together with these terms, forms the agreement. Anything not listed in the written scope is out of scope and may be quoted separately.

SOS does not provide music production, mixing, mastering, photography, videography, cover art creation, paid advertising, public relations, playlist pitching, or social media management.

• One-off build projects require a non-refundable deposit of 50% of the agreed project fee before work begins. The remaining 50% is due on completion, before the final files are deployed or handed over.
• Invoices are payable within 7 days of issue. Prices are quoted and charged in US dollars.
• Monthly hosting and upkeep is billed in advance on a recurring monthly basis from the date the plan starts, and continues until cancelled.
• Founding rates are a genuine limited offer applying to the first five build projects. Once five builds have been contracted, the standard rate applies to all subsequent projects. The rate confirmed in your written scope is the rate you pay.
• If a final balance remains unpaid more than 14 days after completion, SOS may withhold deployment or take the site offline until payment is received.

Each project includes a set number of revision rounds, stated in your written scope (typically two rounds for a one-page site and three for a multi-page site). A "revision round" means one consolidated set of feedback delivered at one time.

Revisions cover refinement of the agreed design and content: copy changes, layout adjustments, colour and type tuning, and corrections. They do not cover a change of creative direction after a design has been approved, or the addition of pages, features or functionality not in the agreed scope. Additional rounds and out-of-scope work are billed at $60 per hour, quoted and approved in writing before starting.

Before work begins. If you cancel in writing before any design or development work has started, the deposit is refunded in full.

After work begins. The deposit is non-refundable once work has started, as it covers time already reserved and worked. If you cancel mid-project, you are billed only for work completed to that point; any amount paid above that is refunded within 14 days.

After delivery. Because every project is custom work made to your brief, completed and delivered projects are not refundable. If a delivered site does not match the agreed written scope, notify SOS within 14 days of delivery and it will be corrected at no cost. If the discrepancy cannot be corrected, a partial refund proportionate to the unfulfilled scope will be issued.

If SOS cancels. If SOS is unable to complete a project for any reason, all monies paid for undelivered work — including the deposit — are refunded in full within 14 days.

Approved refunds are returned to the original payment method within 14 days of agreement. To request a refund, email scratchedoutsociety@gmail.com with your project name and invoice reference.

The Upkeep plan is a rolling monthly service with no minimum term. You may cancel at any time by emailing scratchedoutsociety@gmail.com. Cancellation takes effect at the end of the current paid billing period; the service remains active until then and no further payments are taken.

Monthly fees already paid for the current period are not refunded on cancellation, since the service has been provided for that period. Upon cancellation, SOS will provide you with a full export of your site files so you can host the site elsewhere. Site files are retained for 30 days after cancellation and may be deleted thereafter.

SOS may suspend hosting for non-payment after 14 days' overdue notice, or terminate a hosting plan with 30 days' written notice, providing a full file export in either case.

On receipt of full payment, you own the final delivered website design, brand assets and site source code for your project, and any domain registered in your name. You retain ownership of all content you supply — music, images, logos and copy.

SOS retains ownership of any underlying generic tooling, code libraries and internal components used across projects, and retains the right to display the finished work in a portfolio and on social media unless you request otherwise in writing.

Third-party fonts, plugins, stock assets and services used in a project remain subject to their own licences, which are passed to you at cost where applicable.

• You must supply content — text, images, audio, links — in a timely manner. Projects stalled awaiting client content for more than 30 days may be paused, and resuming may require rescheduling.
• You confirm you own or are licensed to use all content you supply, and that it does not infringe anyone's rights.
• You agree not to use any site built by SOS for unlawful, fraudulent, or deliberately harmful purposes.

Services are provided with reasonable skill and care. SOS does not guarantee any particular commercial result, traffic level, ranking, streaming or booking outcome from a website.

To the maximum extent permitted by law, SOS's total liability arising from any engagement is limited to the total amount paid by you for that engagement. SOS is not liable for indirect or consequential losses, or for outages, failures or data loss caused by third-party hosting providers, domain registrars or platform services.

These terms may be updated from time to time; the version in effect at the date your project is confirmed is the version that applies to it.

Scratched Out Society is an independent sole-operator design studio operating remotely. All enquiries, support requests, refund requests and cancellations are handled by email.
